iWebCustom
1. Scope
These Terms & Conditions apply to all services and offers provided by iWebCustom, owner Peter Tantchev, in the areas of web design, web development, SEO, e-commerce, digital marketing, consulting, technical maintenance, and support.
By accepting a quotation, whether in writing or electronically, the client agrees to these Terms & Conditions.
2. Services
The scope of services is defined in the respective quotation, offer, or written agreement.
Any additional services, revisions, feature requests, or extensions beyond the agreed scope will be quoted and billed separately.
3. Quotations and Contract Formation
Unless otherwise stated, quotations remain valid for 30 days.
A contract is formed upon written acceptance of the quotation, email confirmation, or formal assignment by the client.
4. Pricing and Payment Terms
All prices are stated in Swiss Francs (CHF) unless otherwise agreed.
Unless otherwise specified, the following payment terms apply:
- 50% upfront payment at project start
- 50% final payment upon project completion / website launch
Payment term: 10 days net
In the event of late payment, iWebCustom reserves the right to suspend work or temporarily deactivate delivered services.
5. Client Responsibilities
The client agrees to provide all information, content, access credentials, text, images, and approvals required for the project in a timely manner.
Any delays caused by missing client input may result in corresponding adjustments to the project timeline.
6. Acceptance and Approval
Upon completion of the agreed services, the client will be given the opportunity to review and approve the work.
Unless significant issues are reported in writing within 7 days, the work shall be deemed accepted.
7. Intellectual Property and Usage Rights
All rights to concepts, designs, source code, layouts, graphics, and created content remain the property of iWebCustom until full payment has been received.
Upon full payment, the agreed usage rights are transferred to the client.
Any rights not explicitly transferred remain with iWebCustom.
8. SEO and Digital Visibility
iWebCustom optimizes websites according to current best practices and industry standards.
However, no guarantee is given regarding specific Google rankings, visibility, traffic volume, or lead generation results.
Search engine algorithms and third-party platform changes are outside the control of iWebCustom.
9. Liability
The liability of iWebCustom is limited to gross negligence and intentional misconduct.
No liability is accepted for indirect damages, loss of profit, data loss, or failures caused by third-party services (e.g. hosting providers, payment gateways, plugins, APIs).
10. Third-Party Services and External Systems
iWebCustom accepts no responsibility for services, failures, or interruptions caused by third-party providers such as hosting companies, domain registrars, payment services, plugins, themes, or external platforms.
11. Maintenance and Support
Maintenance, updates, and technical support are only provided separately agreed maintenance or support packages.
Without a separate agreement, there is no entitlement to ongoing support.
12. Cancellation and Project Termination
If the client terminates the project prematurely, all work completed up to that point will be billed according to the time and effort invested.
Any upfront payments already made are non-refundable.
13. Governing Law and Jurisdiction
These Terms & Conditions are governed exclusively by Swiss law.
The place of jurisdiction shall be the registered business location of iWebCustom in Switzerland.
